Design Registration in India: An Overview

Understanding Design in India

A “design” refers to the shape, configuration, pattern, ornamentation, or composition of lines or colors applied to any article. It must be visually appealing and industrially applicable, not just artistic.


Duration of Protection

  • Initial protection: 10 years from the date of registration

  • Extendable: Up to 5 additional years

  • Total possible protection: 15 years


Application Process

To register a design, an application must be filed with the Design Wing of the Indian Intellectual Property Office, including:

  • Applicant details

  • Class classification (as per the Locarno system)

  • Clear representation of the design

  • Statement of novelty


Ensuring Novelty & Originality

Your design must be new and original, with no prior publication or disclosure. Even your own earlier display can invalidate it—so timing is critical.


Examination & Publication

  • The IPO examines the application for compliance and registrability

  • If approved, the design is published in the Official Designs Journal

  • There is a window for third-party opposition post-publication

Registration & Certificate

Upon acceptance, a Design Registration Certificate is issued, confirming your exclusive legal rights to the design.

As the registered owner, you can:

  • Prevent unauthorized use

  • License or assign your design

  • Take legal action against infringers under the Designs Act, 2000


International Protection

Through the Hague Agreement, Indian applicants can protect their designs in multiple countries with a single international application, saving time and effort.
